SDNY Charges Filed Against Epstein for Sex Trafficking Conspiracy

On July 8, 2019, federal prosecutors in the Southern District of New York (SDNY) unsealed a six-count indictment against Jeffrey Epstein. Epstein was arrested that same day at Teterboro Airport in New Jersey as he returned from Paris on his private jet. The charges represented the most serious federal action ever taken against him.

The Charges

The indictment charged Epstein with:

• Sex trafficking of minors (18 U.S.C. § 1591)
• Conspiracy to commit sex trafficking of minors

The charges alleged that between 2002 and 2005, Epstein and co-conspirators recruited and enticed minor girls to travel to his Manhattan and Palm Beach residences, where they were sexually abused. The indictment described a systematic operation in which victims were paid cash and groomed to bring other young girls.

SDNY Jurisdiction

The SDNY charges were notable because they covered conduct in New York — distinct from Epstein’s earlier Florida prosecution. This allowed federal prosecutors to bring new charges not barred by the 2008 NPA, which applied only to Florida. SDNY prosecutors argued explicitly that the NPA did not bind them.

Bail Denial

Epstein sought bail at his initial hearing, proposing home detention with electronic monitoring at his Manhattan mansion. Prosecutors opposed release, arguing he posed both a danger to the community and a flight risk given his private jets, foreign bank accounts, and foreign citizenship (Saudi Arabia was mentioned). Judge Richard Berman denied bail.

Significance

The 2019 indictment was widely seen as a second chance at justice after the perceived failure of the 2008 Florida prosecution. It directly followed the Miami Herald’s November 2018 investigation that re-ignited public and Congressional pressure on the Epstein case.
