The Timeline
On the night of August 9 to 10, 2019:
- Jeffrey Epstein had been removed from suicide watch approximately two weeks earlier
- His cellmate had been transferred out of his cellleaving him alone
- Standard protocol required guards to check on inmates in special housing every 30 minutes
The Guard Failure
Guards Tova Noel and Michael Thomas were assigned to Epstein’s unit that night. Investigations found:
- Both guards fell asleep during their shift
- Neither conducted the required 30-minute check-ins
- Guards subsequently falsified logs to indicate they had made the checks
The Camera Failure
Surveillance cameras positioned to record activity in and near Epstein’s cell were found to be malfunctioning. The Bureau of Prisons and the FBI investigated the camera failures; the full camera footage from that night near cell 9S was not preserved or recovered.
The Multiple Failures
An investigation by the DOJ Inspector General found a pattern of MCC institutional failures:
- Severe understaffing (guards were working extended overtime shifts)
- Training deficiencies
- Equipment maintenance failures
- The unit was operating at reduced staffing levels the night Epstein died
The Guards’ Fate
Guards Noel and Thomas were indicted in 2019 for falsifying records and lying to investigators. The case was ultimately dismissed in 2021 after the government chose not to proceed to trial, citing Noel’s compliance with her deferred prosecution agreement.
