The 2008 non-prosecution agreement closed the federal criminal case against Epstein but did not extinguish victims’ civil rights. What followed was a decade of civil litigation by “Jane Doe” plaintiffs that produced some legal accountability and, ultimately, a historic finding that the NPA itself had been illegally executed.
Civil suits filed after 2008:
Multiple victims — many filing as “Jane Doe” to protect their identities — filed civil suits against Epstein after 2008. These suits sought financial compensation for the abuse they suffered.
The CVRA challenge:
The most legally significant civil action was the challenge brought under the Crime Victims Rights Act (CVRA) by victims who argued that the government had violated their rights when it entered the NPA without notifying them, as the statute required.
This case was litigated for years in the Southern District of Florida. In February 2019, Judge Kenneth Marra issued a ruling that the government had indeed violated the CVRA by keeping the NPA secret from victims during negotiations.
What the ruling accomplished:
Judge Marra’s ruling was significant for accountability purposes but did not void the NPA — it could not undo the completed sentence. The ruling did, however:
- Formally establish governmental misconduct
- Provide a basis for victims to seek civil damages
- Contribute to public and political pressure that eventually led to Acosta’s resignation
The Maxwell civil cases:
Separately, victims filed civil suits against Ghislaine Maxwell. Virginia Giuffre’s civil suit against Maxwell was settled in 2017. Documents from that litigation, including a deposition by Giuffre, were later unsealed over Maxwell’s objections — releasing significant new information to the public.
After Epstein’s 2019 arrest:
New civil suits were filed against Epstein pending his 2019 trial. After his death, claims transferred to his estate. The estate ultimately paid $121 million in settlements to victims.
