2008: Florida State Charges
Jurisdiction: Southern District of Florida (state charges, not federal) Charges:
- Solicitation of prostitution
- Solicitation of prostitution involving a minor Sentence: 18 months county jail; 13 served with work release; 12 hours/day off-campus Registry: Required to register as a sex offender, Level 3
Key features: State charges are categorically different from federal trafficking charges. The classification of victims as “prostitutes” rather than “trafficking victims” had profound implicationsit framed minors as willing participants rather than victims of a federal crime.
2019: Federal SDNY Charges
Jurisdiction: Southern District of New York (federal) Charges:
- Sex trafficking conspiracy
- Sex trafficking of a minor Maximum sentence: 45 years (combined) Status: Dismissed upon Epstein’s death, August 10, 2019
Key features: Federal sex trafficking charges under the TVPA carry mandatory minimum sentences, and trafficking a minor does not require proving force, fraud, or coercion. The 2019 charges reflected what prosecutors said they always had enough evidence to bring.
Why the Difference Matters
The gap between the two sets of charges illustrates the argument that the 2008 deal was an extraordinary departure from normal prosecutorial practice. Federal prosecutors in 2019 assembled their case in roughly one year using largely the same victim pool available in 2008.
