The Three Tier System
Federal law (SORNA) and most state systems classify registered sex offenders into three tiers based on the nature of conviction and risk assessment:
- Tier 1 (Level 1): Lowest risk, minimum registration requirements
- Tier 2 (Level 2): Moderate risk, intermediate requirements
- Tier 3 (Level 3): Highest risk, most stringent requirements
What Tier 3 Requires
Tier 3 classification typically requires:
- Registration for life (in many jurisdictions)
- Registration updates every three months
- Public notification to community
- Restrictions on where offender may live or work
Epstein’s Classification
New York courts classified Epstein as a Level 3 offender the highest tier. He contested this classification but it was upheld.
The Work Release Irony
The combination of Level 3 registration (indicating highest community risk) with extraordinary work release privileges (allowing 12 hours/day outside of custody) represents one of the starkest illustrations of preferential treatment in the case.
Compliance Issues
Epstein’s compliance with Level 3 requirements across multiple states was reportedly imperfect, given his extensive movement and multiple properties.
