Alan Dershowitz and Jeffrey Epstein

Harvard Law professor Alan Dershowitz helped negotiate Epstein's 2008 non-prosecution agreement and was later accused by Virginia Giuffre of sexual abuse, allegations he vehemently denied.

Overview

Alan Dershowitz, one of the most prominent criminal defense attorneys in the United States and a long-serving Harvard Law School professor, was a member of Jeffrey Epstein’s defense team that negotiated the 2008 non-prosecution agreement with federal prosecutors. He later became the subject of serious sexual abuse allegations made by Epstein victim Virginia Giuffre (Roberts).

Role in 2008 NPA

Dershowitz joined Epstein’s legal teamwhich included Ken Starr and other prominent attorneysin negotiations with the U.S. Attorney’s office in Miami (Southern District of Florida). The resulting non-prosecution agreement:

  • Granted Epstein immunity from federal prosecution
  • Limited him to an 18-month county jail sentence with extensive work release
  • Provided immunity to unnamed co-conspirators

Critics focused on the extraordinary leniency of the deal, which CVRA litigation later found violated victims’ rights. Dershowitz defended the agreement as consistent with the evidence available and appropriate given prosecutorial standards of the time.

Giuffre Allegations

Virginia Giuffre, a central Epstein victim and survivor advocate, alleged in court filings that Dershowitz was among the men she was forced to have sex with while under Epstein’s control. She made these allegations in 2015 filings.

Dershowitz categorically denied the allegations, calling them false and defamatory. He stated he had never met Giuffre except briefly at Harvard. He counter-sued Giuffre for defamation after she publicly repeated the accusations.

The legal dispute between Dershowitz and Giuffre stretched across several years and multiple proceedings. In 2023, Giuffre and Dershowitz reached a confidential settlement. Giuffre issued a statement acknowledging she “may have been mistaken” about Dershowitza concession that Dershowitz’s legal team characterized as a complete vindication.

Victim advocates noted that Giuffre had made the accusation consistently for years and raised concerns about what the settlement meant for her credibility as a witness in other proceedings.

Relationship With Epstein

Beyond his legal role, Dershowitz acknowledged a social relationship with Epstein, including visits to Epstein’s properties. He described Epstein as a “brilliant” man and defended him publicly even after his 2008 conviction, until the relationship became a liability after the 2019 federal charges.
