The Senate Judiciary Committee took up the Epstein case, particularly following the 2019 arrest and death. Hearings examined the 2008 plea deal, victim rights violations, and the failures at MCC that preceded his death.
The Focus on the 2008 NPA
Congressional oversight of the NPA focused on: why it was negotiated in secret without victim notification; why it included the extraordinary co-conspirators protection; and what federal oversight of U.S. Attorney’s offices exists to prevent such deals.
The FBI Investigation Failure
Senators questioned why the FBI did not open a more aggressive independent investigation after the initial Palm Beach case, rather than deferring to Acosta’s controversial deal.
The MCC Death Inquiry
Following Epstein’s death, congressional oversight of the Bureau of Prisons examined: the decision to remove suicide watch; the understaffing at MCC; the failure of camera systems; and the guard conduct the night he died.
Legislative Responses
Congressional oversight produced some legislative proposals: strengthening the CVRA, improving prison monitoring requirements, and tightening the rules for federal non-prosecution agreements. Some proposals were passed; others remained in progress.
