NDA Basics
A Non-Disclosure Agreement (NDA) is a legal contract in which one party agrees not to disclose confidential information to third parties:
- Widely used in legitimate business contexts (trade secrets, employment)
- Also used in civil settlement agreements
- Violations can result in civil legal liability
In the context of sexual abuse cases, NDAs prevent victims from speaking publicly about their experiences as a condition of receiving financial compensation.
How Epstein Used NDAs
Epstein’s NDA use fell into several categories:
Category 1: Settlement NDAs with Victims
After individual victims filed civil claims or threatened to do so, they were approached about settlements:
- Victims received financial compensation in exchange for NDAs requiring silence
- The NDA prevented them from speaking to media, investigators, or cooperating with criminal authorities (to the extent permissible by law)
- Some victims were young women who did not have legal counsel when signing
Category 2: Employee NDAs
Household staff at all Epstein properties signed NDAs:
- Groundskeepers, housekeepers, cooks, security personnel
- The NDAs covered anything they observed while employed by Epstein
- These silenced potential witnesses to the operational details of the properties
Category 3: Massage Therapist NDAs
Women who worked as massage therapists — who might have witnessed or been asked to participate in trafficking — signed NDAs as a condition of employment continuation.
The Limitation of NDAs Against Criminal Investigation
NDAs cannot legally prevent someone from:
- Cooperating with criminal law enforcement
- Responding to lawful subpoenas
- Reporting crimes to authorities
However, in practice, the threat of lawsuit for NDA violation and uncertainty about legal boundaries caused many Epstein-adjacent witnesses to remain silent even when approached by investigators.
The Palm Beach Investigation’s NDA Problem
When Palm Beach Police investigated in 2005-2006, they encountered:
- Massage therapists who had signed NDAs
- Staff who had signed NDAs
- Former employees uncertain about their legal obligations
The NDA pattern made building the case more difficult and contributed to the investigation’s limited scope.
Post-2019 NDA Debate
The Epstein case contributed to broader national debate about NDA use in sex abuse contexts:
- Multiple states passed laws prohibiting NDAs that silence sex abuse reports
- The federal SPEAK OUT Act (2022) limited NDA enforcement in harassment and assault cases
- Courts increasingly void NDAs that were obtained through coercion from minors
