Overview
In July 2019, the Southern District of New York (SDNY) unsealed a two-count federal indictment against Jeffrey Epstein charging:
- Sex trafficking of minors (18 U.S.C. 1591)
- Conspiracy to commit sex trafficking of minors (18 U.S.C. 1594(c))
Each count carried a maximum sentence of 15 years in federal prison, for a combined maximum of 45 years. Epstein would have been in his late 80s upon release had he been convicted on both counts.
The Charging Conduct
The indictment alleged that from approximately 2002 through 2005, Epstein:
- Recruited dozens of minor victims (under 18) to give him “massages” at his New York and Palm Beach residences
- Sexually abused the victims during these “massage” sessions
- Paid victims for their abuse and asked them to recruit additional victims
- Knew the victims were minors and that many came from difficult financial circumstances
The charging document identified victims by coded names (e.g., “Minor Victim-1”) and described specific conduct without using victims’ full names.
Why 2002-2005?
The five-year limitations period under 1591 meant that conduct prior to July 2014 would ordinarily be time-barred. However, prosecutors used a continuing offense theory and cited the “10-year enhancement” window for cases involving minors. The period charged gave prosecutors the most clearly documented conduct within the statute.
The NPA Question
The 2008 Florida non-prosecution agreement (NPA) was a major legal obstacle. Epstein’s defense argued the SDNY was barred by the NPA’s immunity clause. Judge Richard Berman ruled the NPA was limited to the Southern District of Florida and did not bind SDNY prosecutors, allowing the New York case to proceed.
Impact of Epstein’s Death
Epstein’s death on August 10, 2019 vacated the indictment. All charges were dismissed as moot. However, the indictment’s factual allegations remained in the public record and formed the basis for subsequent civil proceedings and the prosecution of Ghislaine Maxwell.
